Dya heads Etude Dya Ghose, Attorneys.
After her studies at the University of Mauritius in 2004, Dya joined the legal department of one of the leading companies in Mauritius namely Rogers Capital. She thereafter enrolled as paralegal at one of leading firms in Mauritius. Dya ranked First at her first attempt at the Attorneys Vocational Examinations, Mauritius in 2005. She qualified as Attorney-at-Law in 2006. Dya has worked as consultant for International Financial Services Ltd. She was a lecturer at the University of Mauritius and at the University of Technology, Mauritius. She reckons more than 18 years of experience in the legal field.
Dya specialises in complex corporate litigation, arbitration and insolvency. She has been involved in several heavy weight offshore litigation cases and in high-profile cases. She has a special interest for competition law and has been acting as attorney of the Competition Commission of Mauritius for the past 8 years. She advises clients in a wide range of complex disputes across various areas of law including dispute resolution, commercial law, civil law, competition, arbitration, banking, telecoms, mergers and acquisitions, schemes of arrangements, joint ventures, property matters, debt recovery and labour law disputes.
Dya successfully represented clients in numerous legal proceedings locally and internationally notably in Israel, Zimbabwe, Samoa island, Australia, United States, Germany, Amsterdam as well as in in high profile and politically sensitive matters such as cases relating to proceeds of crime and investigations. She has appeared in a notable cases which has shaped the Mauritian jurisprudence. She also acts as agent before the Judicial Committee of the Privy Council for a number of clients. Dya has been advising clients like JPMP MPL Holdings Ltd, UBS, ASOS, Oberoi Hotels, Microsoft and a number of leading companies in Mauritius.
Dya is a Neuro-Linguistic Programming (NLP) Practitioner and part of IR Global – Africa Group.
Dya is the current President of the Mauritius Law Society and the second woman Attorney to hold this post. She presently serves on the Council for Vocational and Legal Education and on the Rules Committee of the Supreme Court.
She speaks fluently English, French, Creole and Hindi.
Work highlights:
• Defending Administrator’s position in major local and international commercial and arbitration matters following claims of some $ 650 million ,arising out of alleged cancellation of lease agreement by a state.
• Represented a Royal Highness in all her legal proceedings in Mauritius and worldwide, up till the Judicial Committee of the Privy Council to assert her rights in a multimillion-pound inheritance battle. Still advising Her Royal Highness in her trust works in Mauritius.
• Defending a land developer company registered in Zimbabwe in relation to execution of an award delivered by the Commercial Arbitration Centre in Harare against a Zimbabwean statutory body in connection with a USD 22 million arising out of a breach of a housing-offtake agreement,
• Representing a company registered in Samoa, West America in arbitration proceedings under the LCIA-MIAC Arbitration Rules 2018 in relation to a breach of a client’s agreement for brokerage services.
• Representing a management company in connection with a $1.5 million arbitration claim from investment funds arising out of an alleged fraudulent bank transfers.
• Obtaining freezing orders and enforcement of a $ 15 million USD arbitral awards arising out of a diamond business partnership between Israelian partners.
• Advised and represented an authorised company in relation to dispute arising under a funding agreement of value of USD 25 million amongst partners in Nigeria engaged in an agricultural land acquisition.
• Representation of US investors in a $15 million USD claim against a Global Business Company in Mauritius leading to suspension of licence of the said GBC company and total refund of investors’ claims.
• Defending the Competition Commission of Mauritius in High Court appeal proceedings lodged by Visa and Master card against Orders to reduce interchange fees for debit and credit card payments alongside Professor David Bailey, Counsel of Brick Court Chambers, Uk ; assisting Commission in civil cartel investigations up to final decisions and settlements.
• Advising the longest-running and a luxurious hotel group in Mauritius in connection with a restructuring of its business venture.
• Advising Mauritius Telecom, the leading provider of ICT services and solutions in Mauritius on a wide range of disputes and claims.
• Obtaining freezing orders and enforcement of a $15 million USD arbitral awards arising out of a diamond business partnership between Israelian partners
• Defending a local authority in an arbitral claim of MUR 73 million arising from a construction contract.
